Article 3: Products
3.1. Prices
The prices of our products on the site are indicated in euros, including all taxes and excluding delivery charges. They apply when the consumer validates the order (subject to availability).
Please note that if any items have an inconsistent price on the tennispro.fr website (e.g., a racket for 1 euro, a reel of string for 4 euros, etc.), Tennispro may choose not to deliver the customer’s order, and the order will be canceled or returned to Tennispro by the customer if it was delivered by mistake.
Depending on the order amount and shipping destination, shipping charges may be added to the order total (see Delivery below).
Prices are subject to French VAT, and any change to the statutory VAT rate will be automatically reflected in the prices of the products displayed on the Tennispro site on the date stipulated by the implementing decree relating thereto.
Items will be shipped excluding taxes if they are shipped to a country outside the European Union or to the DROM-COM territories. However, customers will be required to declare these items upon receipt.
The displayed retail prices correspond to the selling prices recommended by the manufacturers.
3.2. Availability
The offers presented by Tennispro are valid only while stocks last. In the event of unavailability and in accordance with Article L 121-20-3 of the Consumer Code, you will be informed by email or telephone of any items that are out of stock.
The buyer will then have 72 business hours (excluding Saturdays, Sundays, public holidays, or non-working days) from the purchase date to request cancellation, a refund of the amounts collected, or an exchange of their order up to an equivalent total price by contacting us via our Help Center.
After this period, if you have not made any request, your order will be sent with the available items, and you will be charged only for those items.
Unavailable items will be refunded using the payment method used by the customer to pay for the order.
The customer may reserve goods ordered from our suppliers. If the order is incomplete, Tennispro reserves the right to ship the goods when all the items in the order are in stock. The customer may request immediate delivery of the incomplete order from Tennispro provided that they cover the shipping costs for the second shipment.
3.3. Compliance of Product Offers
The products offered comply with the French legislation in force and with the standards applicable in France.
In accordance with Article L 111-1 of the Consumer Code, consumers may learn about the essential characteristics of the products they wish to purchase before definitively placing an order.
Professional players may play with racket specifications different from those shown.
3.4. Discount Codes, Gift Cards, and Vouchers
Discount Codes
Simply enter the code in the "discount voucher" field located at the top of your cart, and the discount will be applied immediately. Please note that discount codes cannot be combined and always have a specified validity period.
Gift Cards
If you order a gift certificate on our site, we will email you the gift certificate, indicating on it the discount code that the recipient can use to spend the credit received. You will receive the certificate by email in PDF format, so you can print it and give it personally to the person of your choice
Terms and Conditions for Using a Voucher
- Vouchers are considered by us as a means of payment (to pay for part or all of your order). They will necessarily be earned through competitions in which you have participated (tournaments, competitions, championships, etc.).
- Each voucher has an expiration date. You must use your voucher before its "expiration date."
- Vouchers cannot be used on the following products: badminton shuttlecocks, tennis, squash, or padel balls, gift certificates, services (stringing), or products discounted during the statutory sale period.
- The voucher amount must be used in a single transaction. If the full voucher amount is not reached or used, the difference will be permanently lost.
E-Coupons
An "E-Coupon" is a type of "virtual" voucher that gives you a discount on your order (as a fixed amount or percentage). You will receive it by email in the form of a code, which you can use in the designated field during the order validation process.
In your cart, you must enter the EXACT code from your "E-Coupon" in the designated field > then the value will be deducted from your order total to become the "net amount due" for you (that is, the amount you will have left to pay).
3.5. Used Rackets
Used rackets come from our "Test Rackets" program, which is why used rackets show signs of wear that vary from one racket to another. However, all used rackets are inspected and tested by our experts to guarantee their quality and performance before being offered for sale.
Used rackets benefit from a 2-year statutory warranty of conformity. In the event of a defect unrelated to normal use, the customer may return the racket for an exchange or refund. The specific return conditions for used rackets include a period of 30 days from the date the racket is received (extended statutory withdrawal period). If a product is repaired under this warranty, it will benefit from an additional six-month extension starting from the repair date.
To make a return, please contact our customer service via our Help Center or use our form on the Returns page.
3.6. Reservation as Part of a Return
As part of a return request, the customer may optionally request that a product be reserved. This reservation is offered as a commercial gesture and does not constitute a legal obligation. The reservation is valid for a maximum period of 10 days from its confirmation by Tennispro.
If the returned product is not received within this period, the reservation will automatically be canceled at no cost to the Customer. This provision in no way affects the statutory right of withdrawal or the 30-day commercial return period granted by Tennispro.
In the event that the reservation is canceled, the customer may still make a new purchase or benefit from the return conditions provided for in these Terms and Conditions of Sale.
Article 4: Ordering
4.1. Placing an order
These general terms and conditions of sale enter into force on the date the order form for our website www.tennispro.fr is signed. In accordance with the LEN Act of June 21, 2004, you have the option of checking the order details and its total price (price in euros, including all charges, and products plus delivery costs) and correcting any errors before confirming the order to express your acceptance.
However, an order cannot be modified once it has entered the preparation process in our warehouses or stores, or for goods made and personalized according to the consumer's specifications (stringing rackets / fitting grips / fitting overgrips / applying protective tape / flocking / embroidery / …).
Tennispro will acknowledge receipt of your order electronically without delay.
4.2. Transfer of ownership
TENNISPRO SAS retains full ownership of the products sold until full payment of all amounts owed by the consumer in connection with their order, including costs and taxes.
The transfer of ownership of a product purchased on www.tennispro.fr by the consumer to a third party will be handled by Tennispro, a brand of the TENNISPRO SAS group. Only the original purchaser of this product may claim access to the provisions of these general terms and conditions of sale.
4.3. Proof of the transaction
Order forms and invoices will be archived on a reliable and durable medium that may be legally produced as evidence.
Article 5: WITHDRAWAL & WARRANTIES
In accordance with current legislation, our products benefit from the legal right of withdrawal, which we have extended to a period of 30 days from receipt of the order. More information on this page.
Legal guarantee of conformity
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made the seller’s responsibility under the contract or was carried out under the seller’s responsibility.
To conform to the contract, the goods must:
- Be fit for the use normally expected of similar goods and, where applicable:
- Correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- Have the qualities that a buyer may legitimately expect in view of the public statements made by the seller or manufacturer.
A two-year legal guarantee of conformity applies to your purchases, particularly tennis rackets. Therefore, if a racket is defective other than due to normal use, the customer may return it to Tennispro. We will conduct a thorough analysis to determine whether or not it has a defect, after which it will be returned to the supplier. Indeed, under Articles 211-1 to 211-4 of the Consumer Code: Before March 18, 2016, the presumption of prior existence was 6 months from delivery, for all goods. Consumers were not required to provide proof. For goods purchased after March 18, 2016, all defects in conformity appearing during the 2 years following purchase, except for second-hand goods for which the period remains 6 months, are presumed to have existed at the time of purchase. Consumers will not have to provide additional proof, as it is up to the professional to prove that the defect did not exist. You will then be contacted as soon as possible by the Tennispro after-sales service.
If the claim is accepted, the customer may, depending on the product, receive a replacement or repair from Tennispro. If the product cannot be repaired or replaced, or if the customer does not want this, a voucher for an amount equivalent to the purchase price of the item will be offered.
When Tennispro or one of its suppliers is liable, return costs will be covered by providing a prepaid return label.
Credit notes issued as part of a customer return/cancellation are valid for one year only and will be automatically cleared after this period.
If one or more products are refused due to the poor condition of the product(s) (for example: shoes worn after use, racket in blister packaging, etc.), the products will be returned at a cost of €6.90 for Metropolitan France and €10 for other destinations (excluding heavy products).
Racket return: if a racket that has been strung by us is returned, all services and consumables such as string, string installation, grip or overgrip installation, protective tape or logo installation cannot be refunded.
Customized (personalized) rackets cannot be refunded or returned.
